The Minnesota State Bar Association’s “Litigating a Breach of Duty of Loyalty Claim” CLE, presented by TMB shareholder V. John Ella, will be held at the Canal Park Lodge in Duluth, Minnesota on May 2, 2019.
John’s presentation will address how to effectively litigate breach of duty of loyalty claim. Employers are increasingly asserting claim against former employees for breach of their common law duty of loyalty. The seminar will address questions including: What is an employee’s duty of loyalty? What is the measure of damages for a breach? Are injunctions a viable remedy? Is there a difference between fiduciary duty and duty of loyalty? Can a third party be liable for aiding and abetting? Can the claim be preempted by the Trade Secrets Act? What defenses can be asserted to this claim? Is a breach of duty of loyalty a defense to a claim for wages or commissions?
